These straitened times: unlawful service cuts on the Isle of Wight
In R (JM & NT) v Isle of Wight Council  EWHC 2911 (Admin) newly appointed High Court judge Mrs Justice Lang has held that decisions of the Isle of Wight council, which sought to make savings in the council’s adult social care budget, were unlawful for failing to follow guidance or comply with the disability equality duty. The case follows a spate of similar challenges to cuts that have sought to use judicial review to combat the so-called age of austerity.
