The Court could not review a system where the Claimant was not a victim and therefore had no standing.

(i) The Claimant was the Children's Rights Alliance for England, which is a small registered charity and company limited by guarantee. The Claimant's case was that the Defendant was under a positive obligation to inform those who might have been subjected to unlawful restraint procedures that they may have been so subjected. The Claimant contended that it was unlawful/irrational for the Defendant to decline this request.
