(1) The Claimant, an Algerian national, was the subject of a deportation order in accordance with which he was detained. By this claim, he sought a declaration that he had been unlawfully detained and any further detention would be unlawful. He further sought damages for false imprisonment and breach of his rights under article 5 ECHR.
