Detention for four years and seven months pending deportation was self-evidently unlawful where there was no prospect of deportation.

(1) The Claimant sought a mandatory order directing his release from immigration detention. He had been detained for four years and seven months pending deportation to Morocco. The Claimant asserted that he was Palestinian. The Defendant always regarded the Claimant as Moroccan.
