The Defendant had failed to comply with its duty to have due regard to its public sector duties under section 149 Equality Act 2010. Its decision was therefore unlawful.

(1) The Claimant challenged a decision made on 27th September 2011 by the Defendant, a local authority, to deliver library services in 10 areas through Community Partnership Models (CPLs).  The Claimant contended that the Defendant had failed to have due regard to its public sector equality duties.
