Reliance upon an unlawful policy regarding deportation rendered detention pursuant to that policy unlawful.

(1) The Claimant was an Iraqi national who had formerly applied for asylum (this was refused). Following his serving a prison sentence, the Claimant remained detained pending various deportation orders, which were later revoked.
