(1)        The Claimant, a private college established in 2008, applied for judicial review of the Defendant's decision not to grant it ‘highly trusted sponsor status' (‘HTS'). In order to enrol new students, the college required to hold this status. The college's application for HTS status was refused by the UK Border Agency on two grounds:
