Amendments to the Civil Service Compensation Scheme were an interference with Article 1 Protocol 1 ECHR rights that could be justified as proportionate by the government.

(1) The Claimants, which included the two largest civil service trade unions, sought judicial review of a decision made by the Defendant on 22 December 2010 whereby a scheme was introduced under section 1 of the Superannuation Act 1972 amending the Civil Service Compensation Scheme (‘CSCS’), and thereby reducing the benefits paid to scheme members on redundancy and early retirement.
