Removal to Cyprus pursuant to the Dublin Convention did not breach the Claimant’s rights under Article 3 ECHR.

(1) The Claimant, a Tamil Sri Lankan national had formerly been given an identity card by the UN High Commissioner for Refugees, which provided protection against removal to Sri Lanka. The Claimant travelled from Malaysia to Cyprus, where he obtained a false passport to obtain a visa for travel to the United Kingdom. The Claimant travelled to the United Kingdom and claimed asylum in April 2010.
