Administrative Court and Court of Protection
The deprivation of liberty of a Claimant with severe autism could only occur with the permission of the Court.
Summary of Judgment
(1) The Claimant, C, by his litigation friend, sought to challenge the appropriateness of the care plan and provisions applying to him. Extensive relief was sought including disclosure of information, provision of a new care plan and declarations and damages as to breaches of articles 3, 5 and 8 of the EHCR.
