The EAT has held in the case of Secretary of State for Justice v Bowling that a female employee was not entitled to equal pay with a male comparator who started at the same time as her but on a higher pay grade owing to his experience. The original reason for the differential had nothing to do with gender and that reason continued to explain the differential a few years later.
