Additional Paternity Leave Regulations 2010 now in effect

These Regulations apply to the father of a baby due on or after 3 April 2011 or the adoptive parent notified of a match on or after this date and give additional paternity leave:

·         for a maximum of 26 weeks and a minimum of 2 weeks;

·         which must not start until at least 20 weeks after the birth or placement for adoption and must end not later than 12 months after the birth or placement for adoption; and

·         which must only be taken in multiples of complete weeks.

Fathers will be entitled to additional paternity leave provided that the mother has returned to work.  To the extent that the paternity leave is taken during the mother's 39 week maternity pay period, it will be paid leave, and will be paid at the same rate as Statutory Maternity Pay.  Both parents will be required to self certify by providing details of their eligibility to their employer.  If necessary, employers and HMRC will be able to carry out further checks of entitlement.
