Nicholas Mostyn QC, sitting as a deputy High Court judge, had to consider the operation of Brussels II in relation to the enforcement in Austria of an English contact order. In previous proceedings, the mother was given permission to relocate to Austria with her child subject to the English court retaining jurisdiction pursuant to Art 12 to determine the father's extant contact application.
In this ‘classic case to invoke judicial assistance and collaboration under the auspices of the European Justice Network' the deputy High Court judge resolved to send copies of his judgments and orders to the Austrian network judges requesting that they did everything possible to ensure that the English contact order was complied with.
