Re C  EWHC 907 (Fam) - decision of Moylan J in relation to issues of jurisdiction following judicial refusal in English Hague proceedings under article 13(a) and subsequent instigation by left-behind parent (Father) of proceedings in England and then Belgium. Moylan J held that the English court had substantive jurisdiction under article 8 of BIIR or alternatively under article 12(3) of BIIR, and accordingly refused to enforce the Belgium order which granted custody to Father.
