Zinda v Bank of Scotland plc [2011] EWCA Civ 706, [2011] BPIR 1802 (Court of Appeal, Mummery and Munby LJJ and Hedley J, 23 June 2011)

A possession order was made against Z, suspended on terms that he should pay the current instalments plus £96 per month towards the arrears. The arrears and outstanding sum were later consolidated by agreement into a single monthly payment, but further arrears arose. Upon further arrears, the bank sought enforcement.
