Trustee's Remuneration discussed in the High Court by Mrs Justice Proudman - Hunt v Yearwood-Grazette [2009] EWHC B4 (Ch)

10 JUN 2009

Mrs Justice Proudman has considered a trustee's remuneration in Hunt v Yearwood-Grazette [2009] EWHC B4 (Ch). The learned judge notes, inter alia:

"It is common ground that, in exercising its discretion to fix the remuneration, the court should have regard to the Practice Statement, The Fixing and Approval of the Remuneration of Appointees 2004, which sets out the principles which govern the fixing and approval of the trustee's remuneration. These principles are reflected in the more limited statement of Insolvency Practice No.9 and also in the list of factors set out at Rule 138(4) of the Insolvency Rules."
