Stericker v Horner [2012] BPIR 645

H was the supervisor of an Individual Voluntary Arrangement (IVA) entered into by S's husband. S and her husband jointly owned a Spanish property. By the terms of the IVA, as varied, S agreed to pay her share of the net proceeds of the sale of the property into the IVA. After the sale, S did not pay over her interests. H asserted that this constituted a breach of a contract made between him and S and that, in consequence, there became due from her to him a liquidated sum (£8,500 odd) sufficient to found the petition...
