The Court sanctioned the compromise of a liquidator’s claim for breach of fiduciary duty, transaction at an undervalue and transaction defrauding creditors against a former director and those connected with him; see [2009] EWHC 2266 (Ch); [2010] BPIR 262. The majority creditor, who had opposed the application, appealed. In support of his appeal, he sought documents from third parties, by way of a third party disclosure application or under the Norwich Pharmacal jurisdiction.
