Re Sixty UK Ltd (In Administration and Company Voluntary Arrangement); Mourant & Co Trustees Ltd and Mourant Property Trustees Ltd v Sixty UK Ltd (In Administration), Hollis and O'Reilly [2010] EWHC 1890 (Ch); [2010] BPIR 1264

Applying Prudential Assurance Co Ltd v PRG Powerhouse Ltd [2007] EWHC 1002 (Ch), [2007] BPIR 839, the landlord of a tenant company in administration successfully challenged the approval of the company’s Company Voluntary Arrangement. The landlord had been unfairly prejudiced by the stripping of its guarantee rights against the company’s solvent parent company.
