H and W were in the throes of a divorce and ancillary relief. H presented his own bankruptcy petition, and an order was made on it without notice to W. W found out about the bankruptcy petition some months later. On the hearing of the ancillary relief application, the District Judge ordered that W should receive a lump sum equal to the surplus after the bankruptcy debt and costs had been paid.
