Re New Cap Reinsurance Corporation Ltd (In Liquidation) [2011] EWCA Civ 971, (Mummery, Lloyd and McFarlane LJJ, 9 August 2011)

The liquidator of an Australian insurance company obtained judgment in New South Wales against the defendants in respect of various payments made by the company as alleged preferences. By a letter of request, the liquidator requested the English court to exercise its jurisdiction under s 426 of the Insolvency Act 1986 (the 1986 Act), to act in aid of and assist the New South Wales court.
