Re Körffer; Sparkasse Hannover v The Official Receiver and Körffer [2011] BPIR 775

In another German bankruptcy tourism case, a German creditor applied to annul a bankruptcy order made on the debtor’s own petition, on the basis that the order ought not to have been made as the debtor’s COMI remained in Germany, and had not moved to London. Chief Registrar Baister allowed the application.
