Re Gonsalves (a bankrupt); Pickard and Nilsson (Trustees in Bankruptcy of Gonsalves) v Gonsalves [2011] BPIR 419

Deputy Registrar Schaffer found that on a trustee’s application to realise the bankrupt’s solely owned home, the Court had a discretion under s 363 of the Insolvency Act 1986 as to whether to suspend the order for possession. The Court was not bound to order possession within 14 days pursuant to s 89 of the Housing Act 1980.
