Re Derfshaw Ltd [2011] EWHC 1565 (Ch) (Morgan J, 2 Jun 2011)

In seven consolidated cases administrators were purportedly appointed by directors under para 22(2) of Sch B1 but no notice of intention to appointment was given to the company. On the basis of the decision in Minmar (929) Ltd v Khalatschi and Another [2011] EWHC 1159 (Ch), the administrators accepted that the purported appointment was invalid and applied to the court for an administration order with retrospective effect.
