Bankruptcy orders had been made against the two partners in a firm of solicitors. A lender contended that the firm acted negligently and/or in breach of contract and/or in breach of trust in carrying out the lender’s instructions in respect of certain mortgage transactions, as a result of which it had suffered loss.
