Peoples Phone Ltd v Nicolaou [2011] EWHC 1129 (Ch), [2011] BPIR 1477, (His Honour Judge Behrens (sitting as a High Court judge in Leeds) 6 May 2011)

A landlord and tenant agreed a deed of surrender in respect of leased premises. The tenant then sought to enter into an IVA. The chairman of the meeting rejected the landlord’s vote (which exceed 25% of the creditors) at the creditors’ meeting, on the grounds that the debt had been released by the deed of surrender. The IVA was approved.
