Applying the classic principles of Street v Mountford, Sales J held that the claimant company’s occupation of premises at a periodic rent amounted to an implied periodic tenancy rather than a licence or tenancy at will and was a business tenancy protected by Part II of the Landlord and Tenant Act 1954.
