M sought permission to appeal against the refusal to set aside a statutory demand served on him by W; see  EWHC 141 (Ch);  BPIR 472. M admitted the debt but asserted that it was not yet due as there was a legally binding agreement between them that W could not lawfully demand payment until such time as a property was sold, and such sale had not yet taken place.
