Irwin (administrator of Daniel Lynch Ltd) and Daniel Lynch Ltd (in administration) v Lynch and Lynch [2010] EWCA Civ 1153; [2011] BPIR 158

An administrator brought proceedings under s 212 of the Insolvency Act 1986 against former directors of the company. The directors applied to strike out the proceedings, in the basis that an administrator had no locus to bring proceedings under that section.
