Gaardsoe v Optimal Wealth Management Ltd (Chancery Division, J Martin QC, 28 February 2012)

A claim for negligence and breach of contract was issued and served on a company in administration without the permission of the court or the administrator. The claimant sought retrospective permission under para 43(6) Sch B1 to the 1986 Act to continue the substantive proceedings. Unknown to the claimant, the company had entered Company Voluntary Liquidation (CVL) prior to the hearing.
