E-Clear (UK) plc (In Liquidation) v Elia and Others [2012] EWHC 1195 (Ch); [2012] BPIR 732

(Chancery Division, His Honour Judge Mackie QC (sitting as a judge of the High Court), 18 April 2012)

The third defendant sought an injunction to stop a firm of solicitors, FFW, from acting in proceedings against her by a liquidator of a company on the grounds that the firm had previously acted for the first defendant, her son. HHJ Mackie QC (sitting as a judge of the High Court) dismissed the application. There was no evidence that FFW had ever acted for the son and it was clear that he never was a client of FFW. The third defendant had not shown that FFW were in possession of confidential information relating to the son.
