Chelsea Building Society v Nash [2010] EWCA Civ 1247; [2011] BPIR 381

N and U were joint mortgagors in favour of the Society. U reached a full and final settlement with the Society. The Court of Appeal allowed N’s appeal against judgment against her for the balance of the claim, on the basis that the full and final settlement had not sufficiently expressly reserved the Society’s rights against N.
