Brittain (Trustee of the Property of the Bankrupt) v Haghighat and another [2010] EWCA Civ 1521; [2011] BPIR 328

A Deputy Hugh Court Judge ordered the sale of H’s matrimonial home on an application by his trustee in bankruptcy, the sale deferred for three years because of the occupation of a severely disabled son; see [2009] EWHC 90 (Ch); [2009] BPIR 268. H had unsuccessfully sought to review the decision; see [2009] EWHC 934 (Ch); [2009] BPIR 785. H’s appeal against the sale order was dismissed by the Court of Appeal.
