X v X (CPS Intervening): Criminality, Confiscation and Ancillary Relief

Christopher Hames and David Williams, Barristers, 4 Paper Buildings, Temple. With the creation of the ARA, the unified HM Customs and Revenue and the Serious Organised Crime Agency and a government which places the stripping of the assets of criminals high on the agenda, the prospect is for an increase in the frequency with which family practitioners become embroiled in the competing claims of the Crown, the husband and the wife to disputed assets. This article focuses on recent case law including X v X (Crown Prosecution Service Intervening) [2005] EWHC 296 (Fam), [2005] 2 FLR 487. See January [2006] Fam Law 21 for the full article.
