The father's application for a return order was refused on the basis that the mother had established on the balance of probabilities that such an order at this stage would create a grave risk that the child's return to Italy would expose him to psychological harm or otherwise place him in an intolerable situation for the purposes of Article 13(b) of the Hague Convention.
