Safety first? Contact and family violence in New Zealand: an evaluation of the presumption against unsupervised contact [2006] CFLQ 1

New Zealand's Guardianship Amendment Act 1995 introduced a presumption against unsupervised child contact with a non-resident parent who had been violent, unless such contact could be shown to be safe. This article examines how the New Zealand courts have applied the presumption, considers the impact of the presumption, and contrasts the New Zealand approach with that taken in England and Wales.
