BANKRUPTCY/ANCILLARY RELIEF: Rowe v Rowe [2007] EWHC 2589 (Fam)

On the application of the husband's trustee in bankruptcy and the wife, the High Court had jurisdiction to set aside a consent order under which the bankrupt husband's interest in the jointly owned Spanish property, worth about £250,000, was to be transferred to the wife and the wife was to pay the husband a lump sum of £125,000. The husband had failed to disclose his interest in the property to the trustee in bankruptcy, who had been informed of its existence by the wife some years later, after the husband pressed for payment of the final instalment of the lump sum and of outstanding costs.
