(Family Division, HHJ Hunt, sitting as a deputy judge of the Family Division, 4 May 2012)
The six siblings were placed in three different foster homes for 6 months under interim care orders. The foster homes were a considerable distance from the family home, the school and from each other.
The local authority sought to move all six children to different foster homes that were in closer proximity to the family home. The guardians sought an injunction preventing a further move under s 8 of the Human Rights Act 1998. A psychologist report supported the guardians in particular in respect of two of the children.
Application refused. There were no grounds sufficient to prevent the local authority from moving the children.
