FAMILY PROCEEDINGS: Re S-C [2010] EWCA Civ 21

(Court of Appeal; Thorpe and Wall LJ; 28 January 2010)

The mother appealed against a committal order made on the application of the father. The circuit judge found that the wife was in contempt for breaching a non-disclosure order by informing her Turkish lawyer of an English psychologist report describing the father as suffering from a narcissistic personality disorder.

The committal order was set aside on appeal and the mother was found not to be in contempt. The mother had been entitled to show the court's order to third parties and to discuss content of report with her Turkish lawyer. The circuit judge could have made more specific order preventing discussion of report with a third party, but had only specified non-disclosure.
