ADOPTION: Re P-B (Placement Order) [2006] EWCA Civ 1016

(Court of Appeal; Thorpe, Arden and Wilson LJJ; 15 June 2006)

A local authority making a placement application, because it was satisfied that the child ought to be placed for adoption under s 22 of the Adoption and Children Act 2002 (the 2002 Act) was not acting under the auspices of Pts 3 and 4 of the Children Act 1989, but as an adoption agency under the 2002 Act. The local authority could therefore only be satisfied that a child ought to be placed for adoption once the appointed officer had approved the panel's decision, and only at that point could a placement application be issued.
