CONTEMPT: Re M (Contact Order) [2005] EWCA Civ 615

(Court of Appeal, Ward and Clarke LJJ, 11 April 2005) [2005] 2 FLR 1006

Held that the judge had erred in principle. A custodial sentence should not have been imposed until the judge was satisfied that such was justified. A custodial sentence ought not to be imposed simply because the father lacked the means to pay a fine.
