FORCED MARRIAGE: R v B [2010] EWCA

(Court of Appeal; Toulson LJ, Cox J and the Common Sergeant of London; 12 February 2010)

The mother arranged for her daughter, who was born in November 1999, to be married to an adult man. After the marriage ceremony the daughter and the man had sex, at first consensual, then against daughter's will. The man was eventually forced to leave the home because of his ill-treatment of the daughter and other members of the family.

The daughter informed her school that mother was thinking of arranging another marriage. The mother was sentenced to 8 months' imprisonment for inciting a child to engage in sexual activity. She appealed.

The appeal was dismissed as the sentence was not excessive, even given unusual circumstances. The mother had been seeking to control the daughter's behaviour by arranging marriage, and had failed to consider her daughter's best interests, or the legality of her action in the UK.
