CHILD SUPPORT: R (Sturton) v Social Security and Child Support Commissioners [2007] EWHC 2957 (Admin)

(Queen's Bench Division, Administrative Court; Judge Mackie QC sitting as a judge of the High Court; 15 November 2007)

The decision of the Social Security and Child Support Commissioner would be quashed. The Commissioner ought not have rejected the father's appeal against the decision of the child support tribunal, given that he had ignored the tribunal's detailed reasons for their decision; consideration of those reasons was essential to a fair determination of the father's appeal.
