Provision of Justices’ Reasons in Uncontested Cases

In March 2014, the Justices' Clerks' Society and the Magistrates' Association issued joint guidance on the provision of Justices' reasons in uncontested family cases.

Following the decision in Re NL (Interim Care Order: Facts and Reasons) [2014] EWHC 270, [2014] 2 FLR (forthcoming) there is a need to revise part of the November 2007 Joint Guidance in relation to Justices' Reasons in the Family Proceedings Court. The section entitled 'Good Practice in Relation to Uncontested Cases' is no longer sustainable and should be discarded.

The updated guidance has been approved by the President of the Family Division and is available to download here.
