HUMAN RIGHTS: Pini and Bertani; Manera and Atripaldi v Romania (Application Nos 78028/01 and 78030/01)

(European Court of Human Rights; 22 June 2004) [2005] 2 FLR 596

The European Court of Human Rights held that there was a bond between the applicants and their adopted children and that the European Convention for the Protection of Human Rights and Fundamental Freedoms 1950, Art 8 applied. A potential relationship such as that created by a lawful adoption order was sufficient to attract protection under Art 8.
