A female worker who had been dismissed between the in vitro fertilisation of her ova and the implantation of the fertilised ova in her uterus had not been pregnant at the time of dismissal; however, the dismissal had been unlawful on the basis of the Equal Treatment Directive if the dismissal had essentially been based on the fact that she was undergoing in vitro fertilisation treatment.
