CARE CONTACT: Kirklees Metropolitan District Council v S [2006] 1 FLR 333

05 JUL 2005

(Family Division; Bodey J; 5 July 2005)

The local authority appealed an order made by the Family Proceedings Court relating to weekend supervised contact for the mother. On appeal the High Court held that the short-term order fell within the discretion vested in the Family Proceedings Court and that the court had not erred in principle. Had the contact been ordered in the medium or long-term, then it would not have been reasonable and would not have been appropriate. Obiter dicta of Munby Js observations that the needs of the family should not be stunted by resources in Re M (Care Proceedings: Judicial Review) [2003] EWHC 850 (Admin), Bodey J stated that resources were not a totally irrelevant consideration when looking at contact arrangements.
