Kings, Queens and Proctors

If 2006 does not see any registered partnerships annulled, 2007 will surely see the first dissolutions of some of these same-sex unions. Whenever these first non matrimonial causes arrive, we must hope that they do not involve s 39 of the Civil Partnership Act 2004 (Intervention of the Queen's Proctor), namely Mr Paul Jenkins the Treasury Solicitor (TS), the Procurator-General (PG) and thus the Queen's Proctor (HMP) who, in family proceedings, always acts under the direction of the Attorney General (AG) (Mr Jenkins replaced Dame Juliet Wheldon QC, the first female holder of these offices, in Summer 2006).

The purpose of this article is to consider the divorce role of the Queen's (as it has been for some 62% of the near 150 years to date) Proctor from the Matrimonial Causes Act 1860 to the present day and beyond. See December [2006] Fam Law for the full article.
