RESIDENCE: Ismailova v Russia

(European Court of Human Rights; 29 November 2007)

The mother, a Jehovahs Witness, claimed that the decision to grant custody of the two children to the father, who was away at sea for large portions of the year during which time the children were in the care of the paternal grandparents, was a breach of her human rights and a difference in treatment based on religion.

By four votes to three the court held that there had been no violation of the mothers human rights, and no discrimination against her based on her religious views.
