Guidance on exceptional civil legal aid funding in non-inquest cases

The Lord Chancellor has today published revised guidance on civil legal aid funding in non-inquest cases that takes into account Court of Appeal decision in Gudanaviciene and others versus Director of Legal Aid Casework.

The guidance sets out some of the factors that caseworkers will need to take into account when looking at applications for exceptional funding. It should be useful to legal aid providers and potential claimants who are considering applying for exceptional funding.

The revised guidance is issued by the Lord Chancellor under section 4 (3) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 and is available to download here.
